By accessing the Service or using it, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the Service. Please note that only the German version of our General Terms and Conditions applies; translations only serve to promote understanding.
1. Acceptance of Terms

The agreement is between you and Sendcope, Ole Nepomuk Mai, Goethestr. 70, 10625 Berlin, Federal Republic of Germany (referred to as “Sendcope”, operator of the Sendcope website, accessible via sendcope.com) and Clever Elements GmbH, Lohmühlenstr. 65, 12435 Berlin, Federal Republic of Germany (referred to as “Clever Elements GmbH”, operator of the “Service”, the email marketing software itself, accessible via app.sendcope.com). The Terms of Clever Elements GmbH also apply to the use of the Service. If the Terms of Sendcope and those of Clever Elements GmbH contradict each other, the Terms of Clever Elements GmbH apply.

Sendcope reserves the right to update or change these Terms at any time without prior notice. The date of the last update will be displayed above in these Terms. It is your responsibility to regularly check for changes. Continued use of the Service after posting changes constitutes acceptance of those changes.

Sendcope may terminate or suspend your account and access to the Service immediately and without notice or liability for any reason.

The Service is provided “as is” and “as available” without any warranties of any kind, whether express or implied. Sendcope does not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
8. Limitation of Liability
In no event shall Sendcope be liable for any indirect, incidental, special, consequential, or punitive damages or loss of profits or revenue.
9. Governing Law
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
